User Agreement

1. General provisions, definitions, and formation of the agreement

1.1. This User Agreement (the "Agreement") governs the relationship between you (the "User") and the owner of the software (client application), official website, and related materials for GeoJump Secure VPN (collectively, the "Service", "we", or the "Rights Holder") relating to installation, access to, and use of the mobile application, web resources, accounts (if any), in-app purchases of application features through app stores (if offered), and other features of the Service. The Rights Holder is not an ISP-style provider of VPN access over its own servers and is not obliged to supply connection configurations or third-party VPN subscriptions unless expressly stated in a separate document. 1.2. Definitions: • "Content" — interfaces, text, graphics, software code, marketing materials, and other materials made available through the Service. • "Device" — a smartphone, tablet, computer, or other device on which the application is installed or through which the Service is accessed. • "Third-party VPN provider" (or "Provider") — a third party that independently provides or sells you access to its VPN servers, connection configurations, a subscription to such access, or other terms for use of its network. Payment and quality of the VPN as between you and a Provider are governed on the Provider's side. • "Account" — data that identifies the User within the Service or an app store (where such functionality exists). • "Subscription" — where shown in an app store: paid or other access to additional features of the application itself, purchased through Google Play, App Store, or another store; it must not be confused with payment for VPN access from a Third-party VPN provider, which you arrange separately with that Provider. • "Configuration / connection profile" — parameters required to establish a VPN connection that you obtain from a Third-party VPN provider or enter yourself (link, file, QR code, etc.). The Rights Holder is not obliged to supply such parameters and does not warrant their availability, accuracy, or that any Provider nodes will work. 1.3. The Agreement constitutes a public offer to the extent permitted by applicable law. Acceptance means any of: installing the application, creating an account (if any), paying for an application-feature Subscription in a store (if available), enabling a VPN connection using your own configuration, tapping an acceptance control, or continued use after you could review the Agreement. 1.4. If you do not agree to the Agreement, you must stop using the Service and uninstall the application. 1.5. The User confirms that they are at least 18 years old or have reached the age of majority in their jurisdiction and have legal capacity to enter into binding obligations. If you act on behalf of an organization, you confirm that you are authorized to bind that organization to this Agreement. 1.6. Certain features (app store promotions, enterprise access, partner programs) may be governed by additional documents; where they conflict, the special terms prevail for the relevant feature. 1.7. Governing law and dispute resolution: how governing law and disputes are determined is stated by the Rights Holder in the current version on the Service website and/or in the contacts section. Where no specific statement is provided, the parties follow general principles of good faith and reasonable commercial practice; the User agrees that the specific forum may depend on the Rights Holder's place of registration and app store rules.

2. Description of the Service, role of third-party providers, license

2.1. The Service as the GeoJump Secure VPN application is client software (a VPN client): it lets you on your Device establish a secure network connection (VPN) and encrypt traffic using configurations and toward endpoints of Third-party VPN providers that you obtain and deal with independently. The Rights Holder does not sell or provide access to VPN servers, does not operate Providers' nodes, and does not supply you with configurations or commercial subscriptions for Third-party VPN providers' services—you obtain those from your chosen Provider on its terms. Application features include: local storage and management of connection profiles, importing parameters (including via QR code, link, or file), tunnel status notifications, technical information on the Device, and other items shown in the interface. 2.2. Software license: the Rights Holder grants the User a simple (non-exclusive), revocable, non-transferable license to use the application on the Device within the functionality and number of devices permitted by the Service and the app store. Decompiling, modifying, distributing, renting, selling, or creating derivative works based on the application is prohibited except where expressly permitted by law. 2.3. For the VPN tunnel, traffic is routed to nodes specified in your configuration and operated by Third-party VPN providers (or other third parties you choose). The website and app distribution may use hosting, CDN, and other third-party services. As described in the Privacy Policy, the Rights Holder does not collect Users' personal data for operating the client. Payment for an application-feature Subscription (if any) and app installation are handled by app stores and their payment operators under their own rules. The Rights Holder does not control your ISP or carrier and is not responsible for availability, speed, or policies of specific Provider servers. 2.4. Store Subscriptions and paid features (if offered) relate to additional software capabilities, not payment for VPN access from a Third-party VPN provider, unless the store listing explicitly states otherwise. Price, term, auto-renewal, payment, and cancellation follow Google Play, App Store, or the relevant store and/or payment provider. Refunds follow store rules and law. Payment for a Third-party VPN provider's services is arranged with that Provider and is not governed by this Agreement. 2.5. Speed limits, concurrent sessions, node availability, blocking, and maintenance are determined by Third-party VPN providers, networks, and your Device settings; the Rights Holder does not warrant third-party servers will work. Some application features may be "beta" without stability guarantees. 2.6. VPN is not "absolute" anonymity and does not exempt anyone from the law. Circumvention effectiveness depends on the Provider, network, and other factors and is not warranted by the Rights Holder. 2.7. Updates: the Rights Holder may release updates and change functionality. Continued use after an update means you agree to the current Agreement unless stated otherwise.

3. Permitted use and prohibitions

3.1. The User undertakes to use the Service only lawfully and in accordance with this Agreement, the Privacy Policy, app store rules, and the laws of the User's country of residence and citizenship. 3.2. Use of the Service (including the VPN tunnel) is prohibited for: • distributing malware, phishing, spam, or unsolicited bulk messaging; • unauthorized access to computer systems, password guessing, exploiting vulnerabilities, DDoS attacks, or other actions that impair information security; • infringing copyright and related rights or unlawfully circumventing technical protection measures for content; • trading in prohibited goods or services, money laundering, or financing unlawful activity; • harassment, threats, discrimination, distribution of child sexual abuse material, or other content unlawful under applicable law; • operating or supporting botnets, or cryptocurrency mining without explicit permission from the owner of the relevant network / Third-party VPN provider; • overloading a Third-party VPN provider's, your own, or others' networks, automated scanning without permission, or attempts to bypass account or billing controls; • spreading knowingly false information for commercial purposes in a way that threatens safety or third-party rights; • any conduct that violates sanctions, export control, or sector regulation applicable to the User or the Rights Holder. 3.3. The User bears full responsibility for the content of their traffic and for the consequences of using the Service. The Rights Holder is not obliged to pre-moderate User traffic and cannot technically guarantee detection of violations before they manifest. 3.4. Upon a lawful request from competent authorities or where there are reasonable grounds to believe use of the Service threatens infrastructure or third-party safety or violates the law, the Rights Holder may suspend or restrict access, block an account or specific nodes, or remove unlawful content from its own resources (not applicable to encrypted User traffic to the extent described in the Privacy Policy). 3.5. Sharing access to an application account (if any), Third-party VPN provider configurations, or your Device with others is permitted only if it does not breach app store rules, Provider terms, or applicable law, and does not create abuse risk; the User is responsible for anyone who gains access through their Device or credentials.

4. Privacy: no personal data collection by the operator

4.1. The Service Privacy Policy is published on the website and/or in the application and explains that the Rights Holder does not collect, store, or process Users' personal data for VPN and application operation within the scope described there. The Privacy Policy forms part of the rules for using the Service. 4.2. The User confirms they understand that the Rights Holder is not the operator of your VPN network and does not collect personal data for the client as described in the Policy; information related to an application-feature Subscription in a store or installing the app may be processed by stores and payment partners under their rules. Personal data and contractual relations with a Third-party VPN provider are governed by that Provider's policies and terms. 4.3. Protecting connection configurations, local application settings, and Device security is the User's responsibility. Reports of abuse or threats to infrastructure security may be sent via Telegram @Geojump_help or using other contacts listed on the Service website. 4.4. Use of the Service may require operating system permissions (network, camera for QR codes, notifications, etc.). Denying permissions may limit functionality; that does not constitute grounds for a claim of "failure to provide the service" where the limitation is caused by Device settings. 4.5. Local storage: settings and connection parameters may be stored only on the User's Device and are not transmitted to the Rights Holder to identify you personally or for behavioral analytics under this Agreement. The User is responsible for backup and for deleting data before transferring the Device to third parties.

5. Disclaimer of warranties and limitation of liability

5.1. The Service is provided "as is" and "as available". The Rights Holder does not warrant uninterrupted operation, error-free performance, fitness for the User's particular expectations, compatibility with every Device model and network, or preservation of data on the User's Device. 5.2. To the maximum extent permitted by applicable law, the Rights Holder, its affiliates, licensors, and suppliers shall not be liable for indirect, incidental, special, punitive, or consequential damages; loss of profit, data, or goodwill; outages; acts or omissions of ISPs; unavailability, quality, or legality of Third-party VPN providers' services and their configurations; blocking by authorities or third parties; or damage arising from use or inability to use the Service or Providers' networks. 5.3. The User agrees to indemnify the Rights Holder for losses, including legal fees and defense costs, arising from third-party claims caused by the User's breach of this Agreement or applicable law when using the Service, where such wording is permitted by applicable law. 5.4. Nothing in this Agreement limits liability for death or personal injury, or other liability that cannot be limited or excluded under mandatory law.

6. Changes to the Agreement, suspension, and termination

6.1. The Rights Holder may amend the Agreement. The current version is published on the Service website and/or brought to the User's attention through the application (launch screen, push notification, email — as feasible). 6.2. If the User continues to use the Service after changes take effect, the changes are deemed accepted. If the User disagrees, they must stop using the Service and, if applicable, cancel the application-feature Subscription under app store rules. 6.3. The Rights Holder may suspend or end support for the application or limit certain Service features in case of breach, security risk, lawful request, or technical reasons. Restricting access to Third-party VPN provider nodes is done by Providers or other third parties, not by the Rights Holder as owner of those nodes. Such measures do not imply the Rights Holder processes personal data beyond the Privacy Policy. 6.4. Termination does not release the User from obligations that by their nature survive (license restrictions on downloaded materials, limitation of liability, arbitration clauses — where applicable). 6.5. The User may stop using the Service at any time by uninstalling the app and, if applicable, cancelling a store Subscription for application features. Contracts with Third-party VPN providers end under their rules. The Privacy Policy describes lack of personal data collection by the Rights Holder as client publisher and data kept locally on the Device.

7. Intellectual property, third-party services, and contacts

7.1. All intellectual property in the Service (trademarks, logos, design, code, text) belongs to the Rights Holder or is used under lawful licenses. Any use without written permission is prohibited except as expressly allowed by this Agreement. 7.2. The Service may contain links to third-party sites and services, including Third-party VPN providers. The Rights Holder does not control their content, pricing, server availability, or privacy practices; use is at your risk. A link or technical compatibility does not mean partnership, endorsement, or guarantee of any Provider. 7.3. Some software components may be distributed under open-source licenses; notices and license texts may appear in the application or accompanying documentation. 7.4. For questions about this Agreement, claims, cooperation, or support: Telegram @Geojump_help, plus other contact channels listed on the Service website. The User agrees that electronic communications may be used for legally significant notices where permitted by applicable law. 7.5. If any provision of this Agreement is held invalid, the remainder remains in force. Failure by the Rights Holder to enforce a provision does not waive the right to enforce it later.
